TERMS OF SERVICE AGREEMENT

This Terms of Service Agreement ("Agreement," "Terms," or "Terms of Service") constitutes a legally binding contract between you ("User," "you," or "your") and Auldus, LLC, a limited liability company organized under the laws of the State of New York ("Company," "we," "us," or "our"), governing your access to and use of the Auldus Dreams mobile application, associated software, services, and any related digital platforms (collectively, the "Service" or "Application").

ACCEPTANCE OF TERMS
By accessing, downloading, installing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately discontinue use of the Service and delete any downloaded copies. Your continued use of the Service following the posting of any modifications to these Terms constitutes your acceptance of such modifications.

ELIGIBILITY AND ACCOUNT CREATION
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this Agreement. When creating an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other security breach.

DISCLAIMER OF MEDICAL AND PROFESSIONAL ADVICE
THE SERVICE IS PROVIDED SOLELY FOR ENTERTAINMENT, EDUCATIONAL, AND PERSONAL EXPLORATION PURPOSES. THE CONTENT, INTERPRETATIONS, ANALYSES, INSIGHTS, SYMBOLIC EXPLANATIONS, AND ANY OTHER INFORMATION PROVIDED THROUGH THE SERVICE ARE NOT INTENDED TO BE, NOR SHOULD THEY BE CONSTRUED AS, MEDICAL ADVICE, PSYCHIATRIC COUNSELING, PSYCHOLOGICAL EVALUATION, THERAPEUTIC CONSULTATION, OR ANY FORM OF PROFESSIONAL MENTAL HEALTH SERVICES.

By using the Service, you expressly acknowledge and agree that:

  • The Company does not offer, provide, or claim to offer any form of medical diagnosis, treatment, or mental health services;
  • The Service is not a substitute for professional medical, psychological, or mental health advice from qualified healthcare providers;
  • Any decisions, actions, or inactions you take based on the Service's content are your sole responsibility;
  • The Company is not liable for any consequences arising from your interpretation or use of the Service's content;
  • If you are experiencing emotional distress, mental health concerns, or require professional assistance, you should seek help from qualified healthcare providers.

USER CONTENT AND SUBMISSIONS
The Service allows you to submit, upload, or otherwise provide content, including but not limited to dream descriptions, personal experiences, and related information ("User Content"). By submitting User Content, you grant the Company a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in connection with the Service and for research purposes as described herein.

RESEARCH DATA USAGE AND PRIVACY
You acknowledge and consent that the Company may collect, process, and utilize certain data derived from your use of the Service for research, development, and analytical purposes ("Research Data"). Such Research Data may include, but is not limited to:

  • Dream content and descriptions submitted by users (with all personally identifiable information removed);
  • Timestamp data associated with dream submissions;
  • IP-based geolocation data for general demographic analysis;
  • Aggregated usage patterns and interaction data;
  • Anonymized behavioral analytics and user engagement metrics.

The Company commits to ensuring that all Research Data is processed in accordance with applicable privacy laws and regulations. Personally identifiable information ("PII") will be removed or anonymized before any research analysis is conducted. Research Data may be used for:

  • Improving the Service's functionality and user experience;
  • Conducting academic and commercial research on dream patterns and user behavior;
  • Developing new features and capabilities;
  • Publishing aggregated, anonymized research findings in academic or commercial contexts;
  • Collaborating with research institutions and partners for scientific studies.

INTELLECTUAL PROPERTY RIGHTS
The Service and its original content, features, functionality, design, and compilation are and will remain the exclusive property of Auldus, LLC and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Service, except as expressly permitted by these Terms.

PROHIBITED USES
You agree not to use the Service to:

  • Violate any applicable federal, state, local, or international law or regulation;
  • Transmit any material that is defamatory, offensive, or otherwise objectionable;
  • Impersonate or attempt to impersonate the Company, a Company employee, or any other person;
  • Engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service;
  • Introduce viruses, trojan horses, worms, logic bombs, or other malicious or technologically harmful material;
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service.

DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE COMPANY MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS.

LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICE.

TERMINATION
The Company may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in New York County, New York.

SEVERABILITY
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and the Company regarding the use of the Service, superseding any prior agreements between you and the Company relating to your use of the Service.
